Only when the asbestos is exposed during renovation work, or because they are in very bad condition, the asbestos removal legislation obliges the owner to remove the asbestos. Nevertheless, as an owner it is best to have as much asbestos removed as possible in order to preserve the value of your building. So do not wait until the asbestos removal legislation obliges you.
People often ask us whether we can draw up an asbestos removal certificate? In practice, according to the asbestos removal legislation, there is no specific certificate that must be drawn up after removal. Well, an asbestos inventory can be made after asbestos has been removed and that shows that there is no more asbestos in the building. A blank asbestos inventory after the removal of asbestos could therefore be regarded as a certificate of removal of asbestos.
If you are going to renovate, it is therefore best to consider asbestos and safely remove the asbestos applications that are accessible in accordance with the asbestos removal legislation. Re-enclosing asbestos is prohibited. Temporarily fixing or encapsulating to avoid urgent exposure is permitted under the asbestos removal legislation pending final removal. You can then have a new asbestos inventory drawn up after the works have been completed. This is not an asbestos removal certificate, but an asbestos inventory that is blank at best. Also keep in mind that the asbestos removal legislation specifically determines how asbestos must be removed safely.
There are also many asbestos-containing materials that are in very poor condition. This can be dangerous because exposure to wind and weather causes harmful asbestos fibers to spread into the environment. The asbestos removal legislation also obliges owners to ensure that asbestos in poor condition does not pose a risk to the environment. If there is nevertheless a danger to the environment, the asbestos must be removed in accordance with the asbestos removal legislation. Here too, an asbestos certificate can be drawn up afterwards and if this is blank, this could be regarded as a certificate to remove asbestos.
